This is a mandamus proceeding brought in this court to compel the secretary of state to accept and file the declaration of candidacy of W. A. Ekwall, a judge of the circuit court for Multnomah county, for the office of representative in Congress for the third congressional district of this state. Judge Ekwall, the relator, was elected to the office of circuit judge for a term which will not expire until January, 1939, and, before entering upon his duties as such, he took, subscribed and transmitted to the secretary of state an oath which contained the declaration: “I will not accept any other…
