Defendants Stonepath Group, Inc. (“Sto-nepath”), previously known as Net Value Holdings, Inc. (“NETV”), Andrew Panzo (“Panzo”) and Lee Hansen (“Hansen”), have moved pursuant to Rule 56, Fed. R.Civ.P., for summary judgment to dismiss the complaint of plaintiff Emergent Capital Investment Management, LLC (“Emergent”) in action 00 Civ. 7723 (the “Initial Action”).
