City of San Jose v. Superior Court
California Supreme Court
1Opinion of the Court
Opinion
PANELLI, J.
We granted review in this case to settle questions regarding the scope of discovery of peace officers’ personnel records under Evidence Code section 1045. We must determine whether a juvenile is entitled to discover the outcome of disciplinary proceedings stemming from an earlier citizen’s complaint filed against an arresting officer (see Pen. Code, § 832.5; Evid. Code, § 1045, subd. (a)), when that information is relevant to a wardship proceeding (Welf. & Inst. Code, § 602). We conclude that the juvenile is entitled to such discovery.
