BACKGROUND
Plaintiff International Cablevision, Inc., d/b/a Adelphia Cable, commenced this action on December 13, 1990, seeking declaratory and injunctive relief and damages under 47 U.S.C. §§ 553 and 605 of the Cable Communications Policy Act of 1984. As part of a consolidated action, this Court granted plaintiffs motion for summary judgment on the section 553 claim, but dismissed plaintiffs section 605 claim. International Cablevision v.
