MEMORANDUM OPINION

KESSLER, District Judge.

The Federal Trade Commission (“FTC”) brought this action in 1998, alleging that Capital City Mortgage Corporation (“Capital City”), its President, Thomas K. Nash (“Nash”), and Eric J.
