John H. Biggar, Terrence Kendall, David Helfert, and Edmund J. Fleming, Jr. (collectively, “the landowners”), sued the State of Texas and the Texas Department of Highways and Public Transportation 1 (collectively, “the State”), and Travis County (“the County”) alleging (1) inverse condemnation; (2) violations of the Fifth and Fourteenth Amendments to the United States Constitution; and (3) causes of action under 42 U.S.C.A. §§ 1983, 1985 (West 1981).
