EDMONDS, J. —
The appellant asserts that, as the owner of a water right by appropriation, she is entitled to enjoin C. L. Best from polluting Rock Creek in connection with certain mining operations, and also to recover from him damages for such pollution. The judgment from which she has appealed is based upon findings that she does not own the water right claimed by her, and also that any rights which she acquired from her predecessors in interest are subject to an agreement made by them and The Ruby Gold Gravel Mining Co.
