BRODERICK, District Judge.

Before the Court in this action brought pursuant to Pennsylvania’s Bad Faith statute, 42 Pa.C.S.A § 8371, and Pennsylvania’s Unfair Trade Practices and Consumer Protection Law (“CPL”), 73 P.S. § 201-1, et seq., is defendant Liberty Mutual Insurance Co.’s (“Liberty Mutual”) motion for summary judgment and Plaintiffs’ response thereto. Subject matter jurisdiction is based on diversity of citizenship. The parties agree that Pennsylvania law controls the determination of this action.''
