¶ 1 The instant appeal arises from the dismissal of plaintiffs Darren Mareskas-Palcek and David Palcek's complaint for breach of fiduciary duty and conversion, which plaintiffs filed against defendants, the law firm of Schwartz, Wolf & Bernstein, LLP, and Marc Schwartz, individually. The lawsuit was based on defendants' actions during the closing of the sale of Denise E. Mareskas' (decedent) principal residence, which occurred after her death.
