On July 19, 2004, Plaintiff Richard D. Smith filed a one-count complaint against his former employer ACO, Inc. in Wayne County Circuit Court, alleging retaliatory discharge in violation of the Family and Medical Leave Act (“FMLA”), 29 U.S.C. § 2601 et seq. Defendant ACO, Inc. removed the case to this court on August 3, 2004.
