On the 23d day of January, 1855, Wm. W. Chipman was the owner of the land sought to be recovered in this action. The plaintiff claims title through a sale under an execution *298issued upon a judgment recovered by one Smiley, against said Chipman, on said day, in the Superior Court of the City of San Francisco, a certified transcript of the docket of which judgment was duly filed in the office of the Recorder of Alameda County, in which said premises are situate, and became a lien thereon, on the 26th day of January, 1855.
