Frick Company Inc. brought its action against I. H. Lawson o'n a certain promissory note in the amount of $200, executed by him in its favor. This note was dated April 18, 1930. Defendant filed his answer admitting that he executed the note to the plaintiff as alleged, but alleged that the note was given as part of the consideration of a sawmill purchased by the defendant from the plaintiff; that plaintiff, by T. II. Bell, agent, represented to him that such sawmill was in first-class condition; that a few days after the sawmill was set up and put into operation, which was on or about April…
