This was a suit on a note for the purchase-price of a mule, in which note it was stated that there had been no contract or agreement between the parties affecting the subject-matter of the sale except as expressed therein, and that the vendor was not to be bound by any sort of warranty, either express or implied. The defendant seeks to rescind the contract of purchase and sale, alleging knowingly false, fraudulent, and material misrepresentations relative to the condition of the mule at the time the sale was made, upon which he acted to his injury.
