GARTH, Senior Circuit Judge:

Defendant John Willie Malone, Jr., who was one of two defendants, entered a conditional plea of gufity to each count of a three-count indictment, charging him with conspiracy to commit, the substantive crime of armed robbery of an automobile, and use of a firearm during a crime of violence. The district court sentenced Malone to a total of 97 months incarceration, joint and several restitution of $554.00, and a special assessment of $150.
