I. Procedural Background.

The debtor, Christopher A. Pilavis (“Pi-lavis”) appeals from an order of the bankruptcy court that granted Richard Campa-na’s (“Campana”) motion for summary judgment. Campana’s motion sought denial of the debtor’s discharge pursuant to 11 U.S.C. § 727(a)(3) on the grounds that Pilavis failed to maintain books and records from which the debtor’s financial condition could be determined. In response to Campana’s motion for summary judgment, Pilavis filed a cross motion for summary judgment seeking a determination that Campana’s § 727 complaint…
