Appellant Michael Lehtonen was the tenant of an apartment owned by Appellee David Payne, Jr.1 After Lehtonen fell behind in paying the rent, Payne filed a forcible entry and detainer (“FED”) action with the Magistrate Division of the Superior Court seeking Lehtonen’s detainer (“FED”) action with the Magistrate Division of the Superior Court seeking Lehtonen’s eviction.
