Appellant’s decedent, his son, Brian T. Phillips, was one of three passengers on a plane piloted by appellee’s decedent that disappeared off the coast of Italy on March 21, 1987. No remains were ever found. For the next year appellant sought a report of death from the United States Department of State and the Italian and Maltese governments, but in March 1988 the State Department informed him that it would be unable to obtain such a report.
