MEMORANDUM ON MOTIONS FOR SUMMARY JUDGMENT

URBOM, Chief Judge.

The plaintiff and the defendant have filed motions for summary judgment, filings 26 and 24.

Under Rule 56(c) of the Federal Rules of Civil Procedure, the moving party bears the burden of showing that there is no genuine issue as to any material fact and that it is entitled to judgment as a matter of law. All doubts are to be resolved against the moving party, and the non-moving party is to receive the benefit of all favorable inferences that reasonably may be drawn from the evidence. Walling v.
