BURCH, J.:

The action was. one to recover damages for injuries to the plaintiff resulting from a defective highway. The plaintiff recovered, and the defendant appeals.

The plaintiff was seated in a buggy, driving a single horse eastward toward her home. The highway ran for some distance along the north bank of a creek. The south side of the highway was supported by a stone wall some two hundred feet lpng, varying in height from one to five feet, and by an earth wall extending about one hundred feet further.
