The plaintiffs seek in this action a judgment declaring that their land is no longer subject to the easement which in 1891 was granted by their predecessor in title to the predecessor in title of the defendant in favor of the land now owned by the latter. This easement is the right to construct and maintain a drain upon the land of the plaintiffs for the purpose of draining the land of the defendant.
