The action is one for a declaratory judgment as to the respective rights of the parties to the steps and a part of the landing of a stairway furnishing ingress and egress from the street to the stair way and thence to the second and. third floors of the adjoining buildings owned at present by the plaintiffs and R. S. and L. R. Pease, and also as to the right of the plaintiffs to a substituted way from this stairway landing through the entrance to defendant’s store to the street.
