OPINION

TYLER, District Judge.

This is a motion by defendant Peat, Marwick, Mitchell & Co. (hereinafter “PMM”) under Rule 23(c) (1), F.R.Civ.P., as amended effective July 1, 1966,1 for a determination that none of the actions entitled Fischer v. Kletz (and fifteen other actions previously consolidated therewith), 65 Civ. 787, Bloch v. Nogg, 65 Civ. 928, and Garber v. MacKensen, 65 Civ. 923, are maintainable as class suits.
