WARLICK, District Judge.

This is an action for an alleged patent infringement. The plaintiff is a New York corporation to which the patent was assigned on November 18,1948. The *869patent Numbered 2,111,136, for a “Wing Turbine Unit” was filed in the United States Patent Office on May 21, 1934, by August Bauer, and was issued to him on March 15, 1938. The patent expired on March 15, 1955. This action was commenced on January 12, 1955.

The patent embodies six claims, but only one is alleged to have been infringed, this being Claim Number 1. The alleged infringing devices are so called centrifugal…
