I. INTRODUCTION
Before the court are the objections to the report and recommendation of the magistrate judge, see 28 U.S.C.A. § 636(b)(1) (West 1993), and a motion for summary judgment, see Fed.R.Civ.P. 56(c). Richland-Lex-ington Airport District (“RLAD”) brought various claims 2 pursuant to the Federal Torts Claim Act (“FTCA”), 28 U.S.C.A. §§ 2671-2680 (West 1965 & Supp.1993), against the United States.
