On July 5, 1905, relator applied to respondent, one of the justices of the peace of the city of Hastings, to take his complaint and issue a warrant against one Herrick for the offense of violating an ordinance of ■the city entitled:
*164“An ordinance relative to licensing the keeping of saloons in the city of Hastings and the conduct thereof, and prescribing penalties for its violation.”
