MORROW, Judge.

—This appeal is from a conviction for murder, the punishment being assessed at thirty-five years confinement in the penitentiary.

The deceased was the husband of appellant’s daughter. A separation had taken place and she had returned to her father’s home, and complained to her father of various acts of abuse, including a charge of infidelity and threats of personal violence. Eyewitnesses for the State described an unprovoked and an unjustifiable homicide.
