DAVIDSON, Judge.

Appellant was convicted of rape, his punishment being assessed at life imprisonment in the penitentiary.

The State’s theory was that appellant committed the offense of rape upon a girl under fifteen years of age, whose name was Georgia Holloway. The identification and alibi were serious questions. Miss Holloway had never seen the defendant before the evening of the alleged rape, and the other witness identifying appellant as going along the street was vigorously attacked.
