Plaintiff, Louis Beckus, a minor, by his father and next friend, George Beckus, appeals from an order of the circuit court of Cook County dismissing his amended complaint. Plaintiff seeks to recover damages from defendant Chicago Board of Education (hereinafter Board) for injuries sustained in a school playground. Defendant, pursuant to section 48 of the Civil Practice Act (Ill. Rev.
