OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW

I. Introduction

On February 28, 2002, we issued an opinion and judgment affirming the trial court’s judgment against Appellant Orvell Daniel Throneberry for evading arrest and sentencing him to twenty-five years’ confinement. Throneberry v. State, 72 S.W.3d 389 (Tex.App.-Fort Worth 2002, pet. dism’d). The Texas Court of Criminal Appeals granted Throneberry habeas corpus relief to file an out-of-time petition for discretionary review, which he has done.
