On August 20, 1914, Emmett Brewer, by Alice Goodman, his next friend, commenced this action against J. S. Dodson and the American Surety Company. The parties occupy the same relative position here, and are referred to, as they appeared in the trial court.

By the petition it is alleged, in substance, that plaintiff is a minor Creek freedman, enrolled as of 4 years of age in September, 1898; that there was allotted .to him 160 acres of land, and upon the death of his father and sister he inherited 320 acres of other lands; that on April 25, 1910, the de-iendant Dodson was…
