Kennestone Hospital, Inc. d/b/a WellStar Kennestone Regional Medical Center (“Kennestone”) and the Georgia Department of Community Health (“DCH”) each challenge the trial court’s order reversing the final decision of DCH awarding a Certificate of Need (“CON”) to Kennestone for an ambulatory surgery center in Acworth, Georgia. The trial court ruled in favor of Cartersville Medical Center, Inc. (“CMC”) and Marietta Outpatient Surgery, Ltd. (“MOS”), which had objected to the issuance of the CON.
