This is an injunction bill brought to enjoin the defendant from diverting the water of the Tualatin river from.its natural channel, into Sucker lake, for manufacturing purposes. The complainant, Shaw, substantially alleges that he is the owner in fee of a certain tract of land which formerly was a portion of the donation land claim of Ambrose Field, deceased, and that the said land lies at and near the *372confluence of the Willamette and Tualatin rivers, the same being bounded one-fourth of a mile on the Willamette river and about a half of a mile on the northern bank of the…
