On July 23, 2007, plaintiff CMS North America, Inc. (“CMS”) filed the instant complaint defendant DeLorenzo Marble & Tile, Inc. (“DeLorenzo”) in the Circuit Court of Kent County, Michigan (“the state court”), alleging that DeLorenzo has failed and refused to pay $33,245.84 that is due on the sale of machinery, see Comp. ¶¶ 6-10.
