This cause is here on appeal from the court of common pleas of Cuyahoga county, and it is sought by injunctive process to restrain the insolvency court from proceeding further in proceedings begun therein for the appropriation of private property for public use, wherein the city of Cleveland and Carl F. Shuler, director of law, are plaintiffs, and the Eoosevelt Hotel Building Company is the defendant.
