RULING ON PLAINTIFF’S MOTION TO COMPEL

DORSEY, District Judge.

Pursuant to Fed. R. Civ. P. 37(a)(2), Plaintiff moves to compel Defendant John McKenna (“Defendant”) to respond to the interrogatories and requests for production dated June 17, 2003, seeking discovery of surveillance materials. For the reasons stated herein, Plaintiffs motion [Doc. No. 40] is denied.
