— Appeal by the People from an order of the Supreme Court, Queens County (Di Tucci, J.), dated *812February 3,1984, which granted defendant’s motion pursuant to CPL 440.10 to vacate his judgment of conviction on the grounds of newly discovered evidence and in the interest of justice, and ordered a new trial.
Order reversed, on the law and the facts, and judgment reinstated.
