This was an action to recover for the care and treatment of one Soutar, furnished and performed at the instance and request of the defendant. The undisputed evidence is that Soutar, having sustained very severe injuries while in its employment, the defendant brought him to plaintiff’s hospital, and that plaintiff received and accepted him as a patient upon the faith of defendant’s promise to pay for his care and treatment.
