VANCE, Circuit Judge:
The appellees, Cristobal Perez-Perez, Ar-istedes Machado-Matos, and Eduardo Cres-po-Gomez, are Cuban detainees who along with more than 1,000 other excludable aliens have filed individual petitions for habeas corpus review of the Attorney General’s refusal to parole them from the Atlanta Federal Penitentiary. After determining that all of the detainees were enti-*1479tied to appointed counsel, the district court selected the three appellees’ cases as test cases and certified an interlocutory appeal under 28 U.S.C. § 1292(b) for resolution of the following controlling question…
