In this action, black Haitian refugees filed claims for damages arising from their alleged unlawful detention at, and the treatment they received in, the Krome Detention Center in southern Florida during 1981-1982. 1 The defendants here are the officials of the Immigration and Naturalization Service (INS) responsible for their detention. Damages were claimed under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, etc., the civil rights provision of 42 U.S.C.A. §§ 1981,1985(3) and 1986, and the authority of Bivens v. Six Unknown Fed.
