This is a consolidated appeal from two judgments of the United States District Court for the Northern District of Georgia. Both cases primarily involve the rights of those Cuban nationals who entered the United States during the Mariel “Freedom Flotilla” in 1980 and are still detained in the Atlanta Federal Penitentiary. 1 The district court, in No. 83-8628, held that the Cubans awaiting parole possessed a liberty interest in their parole from administrative detention and that the Attorney General’s Status Review Plan for the evaluation of parole did not…
