This action was commenced in the district- court of Tulsa county; Okla., by the defendant in error, W. A. Chamness, against E. FI. Myers and Harry M. Cvowe, to recover on a note for $30,000 executed and delivered by said defendants to Chamness. The parties will be referred to as they appeared in the trial court.

The defendant Crowe failed to answer, and judgment by default was rendered against him. Defendant Myers answered, admitting the execution and delivery of the note, and that it had not been paid, but alleged it had been secured without consideration and by reason of the fraudulent…
