OPINION

By the Court, Batjer, J.:

This appeal is from the denial of a pre-trial application for habeas corpus testing probable cause at a preliminary hearing.

A criminal complaint was filed against the appellant charging him with involuntary manslaughter in violation of NRS 200.070, 1 and alleging that the appellant caused his automobile to strike and kill a pedestrian who was crossing a roadway within a marked crosswalk. After a preliminary examination the appellant was bound over to the district court for trial. He sought a writ of habeas corpus. Upon denial of habeas this appeal was taken.
