The appellant, Andrason, was charged with having committed the crime of battery with resulting “serious physical injury” to the victim, a gross misdemeanor. 1 Following a preliminary examination he was held to answer in the district court. In that court he filed a pretrial petition for a writ of habeas corpus in which he challenged the sufficiency of the evidence to bind over and the. constitutionality of the statute under which he was charged.
