David Kitter was killed in the city of Superior at 11 a. m. on August 25, 1938, upon being struck by an automobile operated by the defendant, John Lenard, Jr. Kitter was in a group of persons on a wooden sidewalk, which was four inches above and parallel to the south edge of the concrete pavement of a roadway which was thirty feet wide.
