—Plaintiff sued the city of Seattle to recover damages for personal injuries which he suffered as the result of being kicked by a horse which an employee of the city had tied to a wagon near plaintiff’s property. The issues having been made up, the action was tried to a jury, which returned a verdict in the sum of five hundred dollars in plaintiff’s favor. Thereafter, the city moved for judgment in its favor notwithstanding the verdict, which motion came on to be heard together with a motion which plaintiff had made to reopen the case for the purpose of introducing further evidence.
