Lewis, Chief Justice:

This action was instituted for the specific performance of an alleged contract for the sale of real estate and to recover damages occasioned by the failure to convey the property as agreed. The basic issue concerned the existence of a binding contract for the sale of the property. This issue, together with the question of damages, was submitted to a jury for determination, resulting in the return of a special verdict finding that (1) a contract of sale was entered into between the parties, (2) the defendant (appellant) had breached the contract, and (3) plaintiff had been…
