(Employer) appeals from an order of the Workers’ Compensation Appeal Board (Board) which reversed the decision of the workers’ compensation judge (WCJ) granting Employer’s petition filed under Section 319 of the Workers’ Compensation Act (Act), Act of June 2, 1915, P.L. 736, as amended, 77 P.S. § 671, seeking credit for future workers’ compensation benefits payable to Thomas Smalls (Claimant) against his third-party settlement recovery.
