I. Introduction

Plaintiff, Chevron' Chemical Co., challenges a decision of the U.S. Customs Service (“Customs”) denying Plaintiffs protest filed in accordance with section 514 of the Tariff Act of 1930, as amended, 19 U.S.C. § 1514 (1994). The action involves the proper classification for customs duty purposes of Plaintiffs petroleum derivative, AL-304, under the Harmonized Tariff Schedule of the United States (“HTSUS”). 1 Jurisdiction is predicated on 28 U.S.C. § 1581(a)(1994), and, therefore, Customs’ classification is subject to de novo review pursuant to 28…
