Plaintiff recovered a judgment by direction of the court in an action of assumpsit against defendant for certain lumber claimed to have been sold and delivered by plaintiff to John Cleff, her husband, acting as *277her agent, and which was delivered to him and went into the construction of certain houses built upon land belonging to defendant in the city of Detroit.
