HEDRICK, Judge.
By assignment of error number two, defendant contends the court committed error by denying his motions to quash the warrant, to dismiss the charges against him and his motion in arrest of judgment. Defendant argues that the criminal summons does not allege all the essential elements of G.S. § 49-2 and it was not served within the time mandated by G.S. § 15A-301(d)(2).
